Terms of Service

These Terms of Service ("Terms") govern your use of RelayMCP, including the website at relaymcp.app, the RelayMCP service, the pilot and any paid plans (together, the "Service"). The Service is provided by Excelus Foodbev Pvt Ltd, a company incorporated in India ("Excelus", "we", "us", "our"). RelayMCP is a product and brand of Excelus Foodbev Pvt Ltd.

By joining the waitlist or pilot, creating an account, linking your WhatsApp, starting a trial or paying for a plan, you agree to these Terms and to our Privacy note. If you do not agree, please do not use the Service.
1. The Service
RelayMCP is a personal AI assistant for your own WhatsApp account, delivered as a Model Context Protocol (MCP) server. When you connect it to an AI tool you choose (for example Claude, ChatGPT or Cursor), that tool can read and search your chats, summarise them, draft replies, set reminders and follow-ups, read voice notes and media and, with your approval, send one-to-one messages on your behalf, subject to the privacy controls you set (such as blocked chats and message retention).
The Service is currently in a private pilot and is not generally available. Features, limits and plans may change as we develop it.
2. Eligibility and your account
- You must be at least 18 years old and able to enter into a binding contract under Indian law.
- You may only link a WhatsApp account that you own and are authorised to use.
- You are responsible for keeping your account, devices and the access URLs or tokens for your AI tools secure, and for all activity under your account.
- Tell us promptly at tushar@excelus.in if you suspect unauthorised use.
3. Independent app; WhatsApp's terms
RelayMCP is an independent app. It is not affiliated with, endorsed by or sponsored by WhatsApp or Meta Platforms, Inc. WhatsApp is a trademark of Meta Platforms, Inc.
RelayMCP links to your WhatsApp as a companion device using WhatsApp's multi-device (Linked devices) feature. Because it is an independent app, WhatsApp's terms on unofficial and third-party clients apply to your account. By linking your account you acknowledge this. Our built-in limits are designed to keep your usage personal and human-paced and to minimise any chance of restriction. However, WhatsApp decides how it enforces its own terms, and we are not responsible for any action WhatsApp or Meta takes on your account.
You can unlink RelayMCP at any time from Linked devices in WhatsApp on your phone.
4. Acceptable use
RelayMCP is for personal, one-to-one use only. You agree not to use the Service to:
- send bulk, broadcast, marketing or promotional messages, or any unsolicited messages ("spam");
- contact people who are not in your saved contacts or existing chats, or buy, scrape or use lists of numbers;
- harass, threaten, defraud, impersonate or mislead anyone, or send unlawful, defamatory, obscene or infringing content;
- attempt to bypass, disable or work around the Service's safeguards, rate limits or security;
- resell, sublicense or provide the Service to third parties, or use it on behalf of a business to message customers at scale;
- break any applicable law, including the Information Technology Act, 2000 and the Digital Personal Data Protection Act, 2023.
Built-in safeguards. To keep usage personal, the Service enforces limits that you cannot switch off:
- you approve sends;
- approved messages are queued and sent after a random 30–120 second delay;
- one recipient per message, with no groups, lists or broadcasts;
- a daily cap of about 30 unique recipients;
- saved contacts and existing chats only;
- the same text can go to at most 3 people;
- quiet hours from 9 PM to 9 AM in the recipient's local time.
We may change these limits to protect users and recipients. Messages are not delivered instantly by design.
You remain responsible for every message you approve and for having any consent the law requires to message the people you contact.
5. AI tools you connect
You choose which AI tools to connect. Content that your AI tool reads or generates through RelayMCP is processed by that tool's provider under its own terms and privacy policy, which we do not control. AI-generated summaries and drafts can be inaccurate; review them before relying on or sending them.
6. Your data
You keep all rights to your messages and content. You grant us a limited licence to process them only to provide the Service to you. You can block chats so they are never stored, messages are deleted automatically after 72 hours (adjustable), and unlinking your device wipes your data. Service data will be stored in India (AWS, Mumbai region) in encrypted storage, and we handle personal data in line with the Digital Personal Data Protection Act, 2023. See our Privacy note. You can request deletion at any time.
7. Pilot
The pilot is free and by invitation. We may change, pause or end the pilot, or your participation in it, at any time. Pilot features are provided for evaluation and may be incomplete.
8. Plans, fees and billing
- Prices are shown in Indian Rupees (INR) and exclude 18% GST, which is added at checkout and shown on your invoice.
- Free trial: paid plans start with a 14-day free trial. If you do not cancel before the trial ends, your plan converts to a paid monthly subscription.
- Monthly billing: subscriptions renew automatically each month and are charged in advance to your chosen payment method through our payment partner (for example PayU). We do not store your full card details.
- Price changes: we will give you at least 30 days' notice by email before a price change takes effect at your next renewal.
- Failed payments: if a payment fails, we may retry it and may suspend paid features until it is resolved.
9. Cancellation and refunds
You can cancel anytime before your next renewal. Cancellation, the 7-day refund on your first paid charge and refund timelines are set out in our Cancellation & Refund Policy, which forms part of these Terms.
10. Availability
We work to keep the Service running, but we do not guarantee that it will be uninterrupted, error-free or available at any particular time, and we offer no uptime commitment. The Service depends on third-party services, including WhatsApp and your AI tools, that we do not control.
11. Suspension and termination
You may stop using the Service and close your account at any time. We may suspend or terminate your access if you breach these Terms, especially the acceptable use rules, if required by law, or to protect users, recipients or the Service. When your account ends, we delete your stored data as described in our Privacy note, unless the law requires us to keep it.
12. Disclaimers
To the extent permitted by law, the Service is provided "as is" and "as available", without warranties of any kind, express or implied, including fitness for a particular purpose and non-infringement.
13. Limitation of liability
To the extent permitted by law, Excelus will not be liable for any indirect, incidental, special, consequential or punitive damages, or for loss of data, profits, goodwill, or access to your WhatsApp account. Our total liability for any claim relating to the Service is limited to the fees you paid us for the Service in the three (3) months before the event giving rise to the claim. Nothing in these Terms limits liability that cannot be limited under applicable law.
14. Indemnity
You agree to indemnify Excelus against claims, losses and costs (including reasonable legal fees) arising from your breach of these Terms, your misuse of the Service or messages you approve.
15. Changes to these Terms
We may update these Terms from time to time. We will post the new version here with a new "Last updated" date. If a change is material, we will also notify you by email. Continuing to use the Service after a change takes effect means you accept the updated Terms.
16. Governing law and jurisdiction
These Terms are governed by the laws of India. Subject to applicable law, the courts at Mumbai, Maharashtra have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the Service.
